These Terms form an agreement between you and Tyndale Enterprises, Inc., a Pennsylvania corporation ("Tyndale," "we," "us," or "our"). By using the FRCoach, you agree to these Terms.

What is FRCoach?

FRCoach is our artificial intelligence powered bot, designed to answer questions about flame resistant clothing. FRCoach is available on our various websites, and you can put questions into FRCoach. Using our proprietary artificial intelligence model, FRCoach provides a response to your query.

When you use the FRCoach, you understand and agree as follows:

EXCEPT TO THE EXTENT PROHIBITED BY LAW, WE MAKE NO WARRANTIES (EXPRESS, IMPLIED, STATUTORY OR OTHERWISE) WITH RESPECT TO THE FRCOACH, AND DISCLAIM ALL WARRANTIES INCLUDING, BUT NOT LIMITED TO, WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, SATISFACTORY QUALITY, NON-INFRINGEMENT, AND QUIET ENJOYMENT, AND ANY WARRANTIES ARISING OUT OF ANY COURSE OF DEALING OR TRADE USAGE. WE DO NOT WARRANT THAT THE FRCOACH WILL BE UNINTERRUPTED, ACCURATE OR ERROR FREE, OR THAT ANY CONTENT WILL BE SECURE OR NOT LOST OR ALTERED.

YOU ACCEPT AND AGREE THAT ANY RELIANCE ON THE FRCOACH IS AT YOUR SOLE RISK AND YOU WILL NOT RELY ON THE RESULTS OF A QUERY AS A SOLE SOURCE OF TRUTH OR FACTUAL INFORMATION, OR AS A SUBSTITUTE FOR PROFESSIONAL ADVICE. THE LIMITATIONS IN THIS SECTION APPLY TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW.

Limitation of Liability

WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, OR DATA OR OTHER LOSSES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES THAT MAY ARISE FROM THE USE OF INFORMATION PROVIDED BY THE FRCOACH.

OUR AGGREGATE LIABILITY UNDER THESE TERMS WILL NOT EXCEED ONE HUNDRED DOLLARS ($100).

THE LIMITATIONS IN THIS SECTION APPLY TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW.

Governing Law

These Terms will be governed by the laws of the Commonwealth of Pennsylvania, without giving effect to any principles of conflicts of laws. By using the FRCoach, you agree that any action at law or in equity arising out of or relating to your use of the FRCoach or these Terms will be filed only in the state courts sitting in Bucks County, Pennsylvania, or the District Court for the Eastern District of Pennsylvania, and you hereby consent and submit to the personal jurisdiction of such courts for the purpose of litigating any such action.
